By downloading, installing, or using the MindSpire mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms apply to all users of the App, including users who access the App via a free or paid subscription.
MindSpire is a mental health and wellness application that provides:
Some features are available to all users ("Free Tier"), while others require a paid subscription ("Premium").
You must be at least 13 years old (or 14 years old in the European Economic Area) to use the App. By using MindSpire, you represent and warrant that you meet this age requirement.
If you are under 18 years old, you must have the consent of a parent or legal guardian to use the App.

We reserve the right to suspend or terminate accounts that violate these Terms.
MindSpire offers both a free tier and a Premium subscription. Premium features include access to all meditation tracks, advanced Arena challenges, and other exclusive content.

Pricing is displayed in the App and may vary by region.
A free trial period may be offered to new subscribers. At the end of the trial period, your subscription will automatically renew at the applicable rate unless cancelled before the trial ends.
Subscriptions are billed through your Apple App Store account. Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.
You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial subscription periods, except as required by applicable law.
We reserve the right to change subscription prices at any time. Price changes will take effect at the start of the next subscription period following notice to you.
All content in the App — including affirmations, quotes, meditation tracks, text, graphics, logos, icons, and software — is the property of JoCoding, Inc. or its licensors and is protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms.
You may not:
Content you create within the App (e.g., thoughts entered in the Fire Pit) is processed locally or temporarily on our servers solely to provide the service. We do not claim ownership of your personal content.
You agree not to use the App to:
MindSpire is a wellness and self-improvement application and is not a substitute for professional medical, psychological, or psychiatric advice, diagnosis, or treatment. If you are experiencing a mental health crisis or emergency, please contact a qualified healthcare professional or emergency services immediately.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JOCODING, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless JoCoding, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App or violation of these Terms.
The App integrates with the following third-party services:

Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
For users in the Republic of Korea: disputes may also be resolved in accordance with Korean consumer protection laws, including through the Korea Consumer Agency (한국소비자원).
For users in the European Economic Area: you may also have the right to use an alternative dispute resolution (ADR) procedure or to file a complaint with your local consumer protection authority.
We may update these Terms from time to time. When we do, we will:
